Conditions of Use
VALID FOR DELIVERIES INSIDE OF GERMANY AND DELIEVERIES INTO EU-COUNTRIES
OR NON-EU-COUNTRIES BORDERING THE FEDERAL REPUBLIC OF GERMANY
1. Applicability
For all business relations between Sales and Marketing and the customer, only our General Terms and Conditions will be binding in their version valid on the date of order.
Any variations of the customer to this Agreement must be confirmed by us in writing.
2. Conclusion of contract
All our quotations are subject to confirmation. A contract between Sales and Marketing is achieved by the order of the customer.
An order of the customer is being made by transmission of the completed ordering form which is provided in the Internet by Sales an
Marketing respectively by ordering via fax, email or phone.
Sales and Marketing accepts the order without sending an order confirmation to the customer.
The order will be effective when the merchandise leaves our depot (normally 24 h after receipt of order at the latest).
Subject to charge your account with our expenses for unclaimed or non accepted deliveries.
3. Delivery
The delivery will be effected to the address specified by you.We deliver your order in one consignment.Should this not be possible for any circumstances, it is understood that we will bare the additional shipping costs.
Initial orders as well as orders placed outside of Germany can not be effected on payment against invoice.
4.Shipping costs
a) INSIDE OF GERMANY
We deliver without shipping costs from 90,00 € purchase order value on.Until 90,00 € purchase order value, we will bill you shipping costs of
7,00 € for payment with PayPal / credit card (DHL).
b) OUTSIDE OF GERMANY (without Switzerland)
We deliver without shipping costs into EU-countries resp. Non-EU-countries bordering the Federal Republic of Germany from 150,00 € purchase order value on.Until 150,00 € purchase order value, we will bill you shipping costs of
19,00 € for payment with PayPal / credit card (DHL),
Deliveries COD and payment against invoice are unfortunately impossible outside the Federal Republic of Germany.
b) OUTSIDE OF GERMANY - SWITZERLAND
We deliver without shipping costs into EU-countries resp. Non-EU-countries bordering the Federal Republic of Germany from 150,00 € purchase order value on.Until 150,00 € purchase order value, we will bill you shipping costs of
32,00 € for payment with PayPal / credit card (DHL)
5. Payment, Reservation of title
The purchase price will be due with delivery.The payment will be effected by the way specified by you on the ordering form.If you have purchased the merchandise payment on invoice, please submit the amount without deduction after receipt of invoice within the period stated on the invoice (normally 7 days).
We are entitled to refuse payment on invoice without specification of reasons.
Should you have chosen payment against credit card, the amount of invoice will be deducted from your credit card account.
We accept Visa and Eurocard cards.
In case of Cash On Delivery (only possible inside the Federal Republic of Germany), the payment of the amount due is done directly to the mail man / driver which delivers.
The delivered merchandise will remain property of the company Sales and Marketing until clearance.
6. Right of withdrawal and return
You are entitled to countermand your order within 14 days after delivery without specification of reasons.
The retraction has to be effected in writing within 14 days after delivery.
To adhere to the time limit, a forwarding of the retraction in time is sufficient.
In case of written declaration of withdrawal, the merchandise has to be returned also within time limit.
Following products will be excluded from withdrawal:
- Already used, opened cosmetics and consumable products
- Products on which the packaging was already unsealed
- Services, which were already started to be supplied before the expiration of the time limit of the withdrawal
Returning of merchandise is effected by return consignment free of charge to our address listed below.
7. Warranty
The warranty period is 6 months from livery of merchandise.
Apparent defects have to be advised in writing within 2 weeks after receipt of merchandise.
In case of a warranty claim, we are up to our choice obliged to elimination of fault, to compensation delivery or to refund the price.
Does the elimination of fault or the compensation delivery fail, you could go back from the order or demand a reduction in price.
Claims of the customer over and above that, particularly claims for compensation, are excluded as long as the damage is not caused by us or our employees wilful or gross negligence.
The presentation of merchandise in the context of our media-/marketing-activity has to be understood as description of goods, not at all as a assurance of qualities.
This applies for other descriptions or illustrations of the merchandise too, e.g. in brochures, magazines or other media.
Particular qualities of merchandise can only be considered as assured, if we have confirmed this explicit and separately in writing.
8. Prices / VAT
The prices are all-in prices in Euro (€) and have to be understood including the valid VAT.
9. Legal regulations
Business relationship between customers and Sales and Marketing are liable to the exclusive court jurisdiction of the courts of the Federal Republic of Germany.
German law will apply to this Agreement exclusively. The Vienna Convention on Contracts for the International Sale of Goods is excluded.
In business relations with merchants and with public corporations, Kirchheim/Teck is agreed as legal domicile for all legal dispute.
In business relations with consumers, the court at the residence of the consumer is responsible for contractual disputes.
In business relations with consumers, the law at the residence of the consumer is applicable, as far as it concerns a mandatory consumer-legal regulation.
10. Data Protection
Sales and Marketing requires for a smooth execution of your order some basic information, your name, your address and – with payment against credit card – the number and the expiration date of your credit card.
For the internal order control, we record furthermore the stringent necessary data as the date of your order and the date of delivery to you.
Certainly, all personal data will be handled confidential and will be protected from unauthorized access of third.
The handling of your data will be held in strict accordance with the applicable federal data protection law and the tele-service data protection law.
According to the legal regulations, you are entitled to contradict a use or transfer of your data for purposes of advertisement or market- and opinion research.
11. Additional information
We cooperate with different partners, which on her part offer internet-sites and services, which are accessible through our sites.
These partners have normally own declarations of data protection and/or –guidelines.
We decline all responsibility or liability for these declarations and guidelines which are not in connection with Sales and Marketing.
All data on our internet presence are copyrighted.
All quoted brands, trademarks, product- and company names resp. logos are properties of the respective owners.
12. Final regulation
If any part of the Agreement is found to be invalid or unenforceable by a court, the rest is unaffected.
The invalid part will be replaced by the relevant legal regulation.
